Harassment, Discrimination and Retaliation
The unfair or unequal treatment of an individual or a group based upon the individual or group's membership in a protected class. An adverse action that is motivated by discrimination violates this policy.
A specific form of discrimination. It is unwelcome and offensive conduct that is based upon an individual or group's membership in a protected class. Harassment may be oral, written, graphic or physical and may include, but is not limited to, offensive jokes, slurs, epithets or name calling, physical assaults or threats, intimidation, ridicule or mockery, insults or put-downs, offensive objects or pictures, and interference with work or academic performance. Harassment is a violation of UND policy when it creates a hostile environment.
While such activity only violates this policy when it rises to the level of a hostile environment, UND reserves the right to take action to address harassment before it becomes so severe and pervasive that it has created a hostile environment.
A form of discrimination and is unwelcome conduct of a sexual nature. It includes unwelcome sexual advances, requests for sexual favors, and other verbal, nonverbal, or physical conduct of a sexual nature. University policy is violated by quid pro quo harassment and harassment that creates a hostile environment.
